BUTTERWORTH: A factory worker, who was arrested following a high-speed chase with police in the Bagan Dalam area last week after he attempted to flee from policemen, pleaded guilty to two charges at the magistrate’s court here today.
Mohd Fadzly Mohd Zahari, 34, admitted to intentionally obstructing Corporal Mohd Shamsuddin Zakaria in discharging his public duty, an offence under Section 186 of the Penal Code.
For that, magistrate Aini Adilah Muhammad Faizal fined him RM3,000 in default of five months’ jail.
Fadzly also admitted to having in his possession 0.99gm of amphetamine, an offence under Section 12(2) of the Dangerous Drugs Act 1952. For that, Aini Adilah imposed a RM3,000 bail pending a chemist’s report.
He was alleged to have committed both offences in front of the Ampang Jajar Flat here about 10pm last Thursday.
A National Legal Aid Foundation lawyer, representing the accused, pleaded for a minimal fine for the offence under Section 186.
“My client’s guilty plea in court has saved the court’s time and cost. He also regrets the offences committed,” she said in mitigation.
She added that Fadzly, who earns RM1,700 monthly, was not married and had to fend for his family. She also appealed for a lower bail for the drug possession offence.
Meanwhile, Deputy Public Prosecutor Siti Marissa Safina Saiful Adli pressed the court for a deterrent sentence.
“The accused failed to adhere to the policeman’s orders. In his bid to escape, he also rammed into the toll gate and drove against traffic.
“What he did was dangerous and endangered the lives of others. As such, we urge for a deterrent sentence,” she added.
Siti Marissa Safina also asked the court to set bail at RM5,000 for the drug offence.

It was reported that a man was arrested following a high-speed chase in the Bagan Dalam area on June 19, after he allegedly attempted to flee from policemen and obstructed civil servants in the performance of their duties.
The incident came to light after a video of the chase went viral on social media.
A body search on the man later revealed a transparent plastic packet believed to contain drugs.
